SUBDIVTOER'S AGREEMENT <br />CITY OF ORONO <br />HENNEPIN COUNTY, MINNESOTA <br />Lake Minnetonka Woods <br />Name of Subdivision) <br />if\ -frik) <br />'Mol' x\ud *1^ ^ <br />filled in oiw <br />8v.K\ ^ <br />pn>o\dJ^i ioiy <br />Lvot' ^ <br />SV l p- (I. <br />Brook Park Realty LLP and Tonka Ventures <br />a Minnesota Corporation <br />(Name of Subdivider) <br />l UlS AGREEMENT, made and entered into this 8th day of March, 1999, by and <br />between the City of Orono, a municipal corporation organized under the laws of the State of <br />Minnesota (hereinafter called "City ”), and Brook Park Realty LLP/Tonka Ventures, a Minnesota <br />corporation, Developer/Property Owners respectively, its successors and assigns, (hereinafter called <br />"Subdivider"). <br />WITNESSETH: <br />WHEREAS, the Subdivider has made application to the City Council for approval <br />of a preliminary plat of land within the corporate limits of the City legally described in Exhibit A <br />attached hereto and incorporated herein by reference (the "Subdivision"); and <br />WHEREAS, the City Council by Resolution No.adopted February 22, 1999, <br />attached as Exhibit B, has granted preliminary approval to the Subdivision, on the condition that the <br />Subdivider enter into this agreement to provide for among other things, the installation of street, <br />water, sewer, other utilities, pathways, landscaring, and any other improvements hereinafter <br />described on the terms and conditions hereinafter set forth. <br />NOW, TEDCREFORE, in consideration of the premises and of the mutual promises <br />and conditions hereinafter contained, it is hereby agreed as follows: <br />1.Warranty of Subdivider . The subdivider hereby warrants and represents to the <br />City as inducement to the City's entering into this agreement, that authentication and <br />verification of the Subdivider's interest that is acceptable to the City will be provided <br />before approval of the final plat.
