A RESOLUTION GRANTING APPROVAL <br />OF A PRELIMINARY PLAT AND 29 UNIT (TOWNHOMES) <br />PLANNED RESIDENTIAL DEVELOPMENT <br />AT 3700-3760 SHORELINE DRIVE <br />FOR BROOK PARK REALTY <br />- FILE NO. 2308 <br />WHEREAS, Brook Park Realty, LLP, the applicant and Tonka Venture, LLC, the <br />owner, (hereinafter the "subdivider") on September 15, 1997, filed a formal subdivision application <br />with the City for approval of a 30 unit Planned Residential Development of property legally <br />described as; <br />Lots 2, 3 and the West 6.29 feet of Lot 4, Block 9, Townsite of Langdon <br />Heights, according to the plat of record thereof, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the Orono <br />Planning Commission held public hearings on October 19, 1997 and November 17, 1997, at <br />which time all persons desiring to be heard concerning this application were given the <br />opportunity to speak thereon; and <br />WHEREAS, at their regular meeting held on December 8, 1997, the Orono City <br />Council considered the subdivision application of Brook Park Realty noting the following <br />findings of fact: <br />1. <br />2. <br />The property is located in the LR-lC-1, One Family Lakeshore Residential <br />Zoning District. <br />The property contains 432,666 sq. ft. or 9.9 total acres, of which 98,970 sq. ft. <br />or 2.2 acres are wet and 333,696.1 sq. ft. or 7.7 acres are dry. The amount of <br />land dedicated to roads is 1.1 acres. <br />At the time of application. Section 10.55, Subdivision 15, provided for <br />residential properties served by municipal sanitary sewer a limited density credit <br />as part of the minimum lot area for purposes of complying with the land use <br />Page 1 of 11
