SUBDIVISION 9(C), <br />SECTION 10.03, SUBDIVISION 9(D), <br />FILE NO. 2612 <br />WHEREAS, Donald C. MacMillan, (hereinafter "the applicant") is the owner of the <br />property located at 2550 Fox Street within the City of Orono (hereinafter "the City") and legally <br />described as follows: <br />Lot 2, Block 1, Beau Marais and Lot 2, Block 1, Beau Marais 2*"* Addition, Hennepin <br />County, Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a variance to Municipal Zoning <br />Code Section 10.03, Subdivision 9 (C) to permit the construction of an oversized accessory structure <br />on the lot with a maximum foot print of 1,600 square feet and Municipal Zoning Code Section 10.03, <br />Subdivision 9 (D) to permit the construction of an oversized accessor>' structure closer to the street <br />lot line than the residence. <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on September 18,2000, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />Miimesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File #2612. <br />2. The proper!)' is located in the RR-IB, Single Family Rural Residential Zoning <br />District. <br />3.The Orono Planning Commission reviewed this application on September 18,2000 <br />and recommended approval by a vote of 7 to 0. <br />Page 1 of 5
