r' > <br />A RESOLUTION DENYING <br />PRELIMINARY PLAT FOR <br />BRENSHELL HOMES <br />FILE #2596 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of the City of Orono has adopted subdivision <br />regulations for the protection of the public health, safety and general welfare; and <br />WHEREAS, Brenshell Homes (hereinafter "the subdivider") has an interest in the <br />property located at 1181 Wildhurst Trail within the City of Orono (hereinafter "the City") and legally <br />described as follows: <br />Lot 2, Block 1, Heathercroft, Hennepin County, Minnesota <br />(hereinafter "the property"); and <br />WHEREAS, the subdivider has applied to the City of Orono for a Class 111 <br />subdivision of the property creating 5 lots on the 7 acre parcel, development of Garden Lane into a <br />public road and has requested variances for lot width for the proposed Lots 2 and 3. <br />WHEREAS, the City Council has reviewed the application; the recommendations <br />of the City staff and the Planning Commission; and the comments and written statements submitted <br />by the applicant. <br />NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, <br />Minnesota hereby denies the requested subdivision as described above based on one or more of the <br />following findings of fact concerning this property: <br />1.The property has a number of sensitive natural features that should be protected and <br />managed when the property develops. The northerly ravine, proposed as Outlot A, <br />would be protected by placing a conservation easement over that area. Proposed Lot <br />2 has proposed some regrading to help redirect storm water to the NURP pond <br />located on Lot 5. Some of the grading is in the proximity of a drainage ravine located <br />along the south property line of Lot 2. <br />Page 1 of2
