*rr <br />r >. <br />f <br />NOW, THEREFORE, BE IT RESOLVED, that based upon cither one or more of <br />the findings noted above, the City Council of the City of Orono hereby approves of the preliminary <br />plat for Robert Pieper for the property located at 3995 North Shore T^iive per the survey (Attached <br />“Exhibit B”), by Milton E. Hyland, of Hy-Land Surveying, P.A. Land Surveyors., subject to the <br />following conditions: <br />1.Public right-of-way shall be dedicate i to the public for the north 33' located over <br />County Road 19. <br />2.Lots 1 and 2 shall share a driveway and be subject to a Driveway Maintenance <br />Agreement and easement in favor of Lot 1 over Lot 2 to be recorded with the final <br />plat. <br />3.A 20' drainage and utility casement shall be dedicated on the final plat along the <br />proposed north property lines of Lots 1 and 2 adjacent to County Road 19 for <br />construction of a drainage ditch to connect the culvert drainage under the County <br />Road to the existing drainage ditch. <br />4.The culvert under the County Road is plugged and shall be reopened. The drainage <br />shall be redirected into the drainage ditch to protect the building site on Lot 2. <br />5.Final Grading, Drainage and Erosion Control plans shall be approved by the City <br />Engineer prior to Final Plat approval. <br />6.Driveway access permit shall be issued by Hennepin County prior to Final Plat <br />approval. <br />7.A letter of credit shall be offered to the City for 150% of the site improvements, <br />improvements to be identified in a Developer’s Agreement to be executed between <br />the subdivider and City of Orono. <br />S.Standard drainage and utility easements shall be dedicated on the final plat 10' along <br />exterior property lines and 5' along interior property lines. <br />Page 2 of 6
