k <br />ti* <br />r <br />s;:‘ <br />w <br />A <br />A RESOLUTION GRANTING PRELII <br />APPROVAL OF A PLAT AT <br />3995 NORTH SHORE DRIVE <br />- FILE NO. 2588 <br />WHEREAS, Robert Pieper, is owner of property located at 3995 North Shore Drive, <br />on May 9, 2000, filed a formal subdivision application with the City for approval of a two lot <br />residential plat of property legally described as: <br />Attached as “Exhibit A”; and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono's zoning, platting and on-site septic codes, the Orono <br />Planning Commission held a public hearing on June 19,2000, at which time all persons desiring to <br />be heard concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, at their regular meeting held on July 10,2000, the Orono City Council <br />considered the subdivision application of Robert Pieper noting the following findings of fact: <br />1.The property is located within the LR-IC Single Family Lakeshore Residential <br />Zoning District requiring a minimum of 0.5 acre of dry contiguous buildable land <br />within each newly created lot. <br />2.The property contains approximately 1.3 acres, of which 0.27 acres would be <br />dedicated on the final plat as public right-of-way. <br />3.The proposed plat contains two lots each meeting or exceeding the minimum lot area <br />requirements for newly created lots in the LR-IC zoning district. <br />4,Lot 1 meets the minimum required width at the structure setback, 170' where 100' is <br />required. Lot 2 has 188.57 ’offrontage along County Road 19 where 100'is required. <br />5.Several cabins exist on the property as individual rental units. They have existed as <br />a non-conforming use.
