Property shall consist of one tax parcel of minimum lot size of five (5") <br />b. Property shall have direct access to a County road. <br />c. County facilities shall only be permitted as Hennepin Countv facilities. <br />d. The Orono City Council shall reserve the right to a periodic review of the <br />conditional use permit, to be determined bv the City Council. <br />e. Use shall be subject to all other provisions of the Municipal Code. <br />If the Planning Commission shall recommend approval of a code amendment to permit the use in <br />the LR-IC zoning district, it would be appropriate to add “County Buildings or Facilities” to the <br />definitions section of the Municipal Code. Section 10.02 would be amended to include 18faV <br />“County Buildings or Facilities” - County buildings or facilities shall include only those structures <br />owned and operated bv Hennepin County. <br />The Jrono Code permits non-conforming uses that were actually and legally devoted to a non- <br />conforming use to continue operation. The Code does, however, not permit the non-confomiing use <br />to be changed to another non-conforming use and/or expand the non-conforming use. Whenever a <br />lawful non-conforming use of a structure or land is discontinued and remains discontinued for a <br />period of 12 months, any future use of structures or land shall be in conformity with the Zoning <br />Chapter. <br />It appears the non-conforming use, as proposed, would actually be less intense than the use that* <br />exists because the number of salt/sand deliveries will be reduced by 60 trips annually and the* <br />salt/sand mix and storage would be relocated indoors. The operation being indoors would also result <br />in less noise. <br />Rezoning the Property <br />If the code would be amended to include the County facility as a permitted or conditional use in the <br />I, Industrial district the property would also be subject to all permitted and conditional uses in the <br />I district. The property is located in a primarily residential area that would not be compatible with <br />many of the uses that are allowed in the Industrial district. <br />Surrounding Properties <br />North, Burlington Northern Rail. <br />South, Property to the southwest is zoned LR-lC-1; the southeast is zoned B-5, Commercial; site <br />access to County Road 15 (Shoreline Drive). <br />East, The City of Orono has recently purchased the immediately adjacent parcel zoned LR-lC-1. <br />West, Residential property.
