All drainage <br />and utility easements along the property lines shall be vacated and new easements shall be <br />dedicated 10 ’ along exterior property lines and 5' along interior property lines. <br />An 8' road easement exists south of the development that is available for the approved <br />roadway agreement. <br />Subdivider shall grant Drainage easements across the wetlands located within the <br />development. Language in the easement documents shall restrict land alteration and removal <br />of vegetation. <br />Park Dedication Fee <br />Park dedication fees were paid for the three lots as part of the original subdivision approval. No <br />additional park impact fees are required. <br />STAFF RECOMMENDATION <br />All the lots meet the zoning district requirements for developments in the LR-IC zoning district. <br />Staff is recommending approval of the application based on the conditions noted in the attached <br />resolution, including the application will not be released by the City of Orono for filing until all <br />documents including the Declaration of Covenants, Conditions, Restrictions and Private Roadway <br />Agreement be amended to include all property in the Tonkawa Shores 2nd Addition. <br />COUNCIL ACTION REQUESTED: <br />To approve or amend the enclosed resolution.
