The new portion of the fence was installed in August. 2001. Staff issued a stop work order for the <br />new fence along Orono Orchard Road and Dickenson Street. The builder contacted Staff shortly <br />after the order and requested to finish the final few posts since nearly the entire fence had been <br />constructed. <br />Landscaping: Along the Orono Orchard Road and Dickenson Street property lines a vegetative <br />bufl'er has been installed by the pioperty owner. The new trees range in height from 13' to 16 ’. The <br />landscaping has consisted of planting a dense row arborvitae trees. The trees are planted leaving no <br />view of the property from the street. The fence has been installed between the trees and the house. <br />The row of arbon itae trees has eliminated view of the fence along the property lines. <br />Along the driveway otTOrono Orchard road 9 pin oak trees with a trunk size of 6" to 7" ha\ e been <br />planted. The full plan includes the following new trees (many have been in.stalled): <br />81 arborvitae trees 13* to 16* in height <br />9 pin oak 6" to 7” in diameter <br />8 spruce trees 20' in height <br />(additional arborvitae to be planted on northwest side <br />of property - number and location has not been <br />determined) <br />Preexisting trees include 8 mature maple trees between the road and newly planted arborvitae. The <br />maples have trunk sizes ranging from 18" to 26", and numerous mature trees along Dickenson Street <br />and west of the house. <br />Landscaping Plan is attached. <br />STATEMENT OF HARDSHIP <br />Applicant's hardship is included with Exhibit A. The applicant should also be asked for their <br />testimonj regarding this issue. <br />Criteria for Determining Undue Hardship <br />1. The property in question cannot be put to a reasonable use if used under conditions <br />allowed by the official controls. <br />The properly is behm put to a reasonable use because in contains a single family residence <br />2. The plight of the landowner is due to circumstances unique to his property not created <br />by the landowner. <br />The relationship of the property is unique because of the property being a corner lot and is <br />14.7 acres in size.
