8 <br />9. <br />The variance, if granted, will not alter the essential character of the locality. <br />The property is in character with the locality. It is a 14.7 acre lot located in the RR-IB <br />district requiring a minimum lot size of two acres. The site would he completely enclosed <br />with a privacy fence and is a black colored chain link style fence. The actual fence, because <br />it is chain link, is transparent and would not have the appearance of a "walled" property. <br />Most ofthe fence will not be visible due to the extensive "dense " vegetation surrounding the <br />property. <br />Economic considerations alone shall not constitute an undue hardship if reasonable <br />use for the property exists under the terms of this chapter. <br />Economic factors are not a consideration with this application. <br />Undue hardship also includes, but is not limited to, inadequate access to direct sunlight <br />for solar energy systems. <br />Solar access is not a consideration. <br />The Board of Appeals and Adjustments or the Council may not permit as a variance <br />for any use that is not permitted under this Chapter for the property in the zone where <br />the affected person's land is located. <br />The use of the property would remain residential which is a permitted use in the zoning <br />district. The construction of the fence does not alter the u.se of the property. <br />The Board or Council may pemiit as a variance the temporary use of a one-family <br />dwelling as a two-family dwelling. <br />The applicant will not be changing the dwelling status of the property. <br />The special conditions applying to the structure or land in question are peculiar <br />to such property or immediately adjoining property. <br />The lot is a corner property with acres. The fence would not be closer than 12'to the <br />west property line and not clo.ser than 6' to the south property line. The last ±500feet and <br />along the south property line and in the northwest corner of the property would not be <br />screened with the dense vegetation. The fence would provide security to the propertyfor the <br />owner of the property. <br />The conditions do not apply generally to other land or structures in the district <br />in which said land is located. <br />Only a limited number of lots in the RR-IB district are of a size (14.7 acres) and dimension <br />(double frontage on nvo public roads) as the subject property.
