^fllNUTES OP A PLANNING COMMISSION MEETING HELD ON NOVEMBER 17, 1980 - PAGE 3 <br />In consideratipn of la^eshore and riparian <br />credit: <br />City has previously established a 75' <br />setback from lagoon - lagoon is part of <br />Lake Minnetonka (so designated in Hannah <br />conditional use permit and variance <br />application). <br />At present the definition of the lakeshore <br />standard of 140 feet of lakeshore does not <br />distinguish between navigable and unnavigable <br />shoreline nor does it specifically expand <br />on concept of riparian rights. <br />City has previously granted access to Lake <br />Minnetonka via walkway easement as in Hannah <br />subdivision. <br />Planning Commission finds that this property <br />meets requirement for subdivision of property <br />into two riparian lots. As to lot configur­ <br />ation, the Planning Commission believes the <br />hor.’ zontal division with walkway acess and <br />limit of four boats to one dock is <br />environmentally more satisfactory than a <br />vertical division. <br />Conditions of approval: <br />a) Creation of approved joint dock - maximum of two <br />boats either stored, moored or docked for each lot. <br />Walkway easement created in favor of Lot 2 by Lot 1. <br />Open space easement over lagoon area. <br />Driveway and utility easement created in favor of <br />Lot 1 by Lot 2. <br />Park Dedication Fee of $400.00. <br />Common curb cut for two plat lots and Hannah property. <br />Proposed house must be setback a minimum of 10' from <br />each driveway easement - 20' wide easejnent serving <br />Lots 1 & 12 - 14' wide easement serving Hannah property. <br />All structures must be setback 75* from shoreline of <br />lagoon. <br />Motion seconded by Goetten.
