Hepp reviewed his final proposal 2605 W. Lafayette Rd. <br />asking for a horizontal division of two lots with SUBDIVISION <br />"full" riparian rights for each lot. Hepp based his (#545) <br />riparian credit on Planning Commission's interpretation <br />of shoreline standard at their last meeting. Staff <br />asked the Commission if shoreline deemed unnavigable <br />could be credited for full ripari.^.; rights. In <br />addition. Planning Commission would also have to <br />recommend approval of a walkway easement through <br />lakeshore lot to afford the necessary access. Rovegno <br />noted that in the subdivision that created the Hannah <br />lot, the City approved a walkway easement through <br />a neighbor's lot to reach his shoreline. <br />Again the Planning Commission cited Council's policy <br />of crediting overall footage of lakeshore for full <br />riparian rights for lots that do not abut the lakeshore. <br />The question of that shoreline being navigable has never <br />been addressed. Planning Commission advised that lagoon <br />areas like this exist throughout the lake area and that <br />a policy determination is needed. This specific lagoon <br />was^ deemed part of Lake Minnetonka by Council and <br />required a 75' setback. In this application Hepp has <br />been asked to meet the same setback. <br />Planning Commission contends that in approving a joint <br />dock concept for the property, Orono's environmental <br />standards would be best served as follows; <br />1. Retain dock at level of one owner usage - limit ■ <br />of two boats per owner. ^ . <br />2. Lagoon area would be further protected by requiring <br />an open space easement ~ applicant will be responsible <br />for obtaining open space easement over Hannah's portion <br />of lagoon. <br />Frahm moved to recommend approval of Bruce Hepp's two lot <br />riparian plat based on the following findings; <br />1. Findings; <br />a) adequate area for two lot subdivision in the LR—IB <br />Zoning District Lot 1 ” 1.6 acres; Lot 2-1 acre <br />b) sufficient sewer and water capacity for Lot 2 <br />c) adequate area of public street providing access for <br />three lots based on following hardships; <br />1. <br />2. <br />oul-de-sac lot has limited frontage on public <br />St^lT00llcity encouraged third user of access by creating <br />access easement for Hannah Lot - the repercussions <br />of agreeing to this easement were not made clear <br />to original owner and future buyer (Hepp).
