0CT-3H)1 HED 12:13 PN DEEPHAVEN CITY HALL FAX NO. 18124741274 P. 14 <br />Section 330:00 <br />All metal fences, enclosures, or railings near or adjacent to residential swimming <br />pools, which might become electrically alive as a result of contact with broken <br />overhead conductors, or imm any other cause, shall be effectively grounded. <br />Section 330:38 Operation and Maintenance. No residential swimming pool shall be used, kept, <br />maintained or operated in the City, if such use, keeping, maintaining or operating shaJI be die <br />occasion of any nuisaitce or shall be dangerous to life or detrimental to health. <br />Section 330:40. Inspection The Community Health Board shall have authority to inspect any <br />residential swimming pool at any reasonable time during construction and thereafter to determine <br />whether or not tlie provisions of this ordinance regarding health, sanitation, operation and safety <br />applicable thereto arc being complied with. The Building Inspector shall have authority to enter <br />upon any premises as it may be deemed necessary to inspect work done and installations made <br />under permits issued by the Building Department. <br />Section 330:42. Lights. No lights sbaJI be installed to illuminate any swimming pool without <br />having first received special permission therefor from the City Council, which will grant such <br />pennission only for the following conditions: <br />a. The lights ore shaded to reflect away from adjoining premises. <br />b. The lights ore not a nuisance to adjoining premises or the neighborhood. <br />c. The liglits are to be used only for emergency purposes. <br />d. Tlie lights arc to be of a low wattage. <br />Secdon 330:44. Location. No portion ofa swinuning pool or appurtenances thereto shall be <br />located at a distance ler s than fifteen feet from any side or rear property line, nor in front of the <br />building line. <br />Section 330:46. EfiilCfiS- All swimming pools shall be completely enclosed by a non-climbing type <br />fence. All fence openings or points of entry into the pool area enclosure shall be equipped with <br />gates. The fence and gates shall be at least four feet in height, six feet in height in the case of <br />above-ground pools, and shall be constructed of a minimum number eleven gauge woven wire <br />mesh corrosion-resistant material, or other materials approved by the Building Inspector. AH <br />gates shall be equipped with self-closing and sclf-Iatching devices placed at the top of the gate or <br />otherwise inaccessible to small children. Fences surrounding above-ground pools shall be kept <br />locked. All fence posts shall be decay or corrosion-resistant and shall be set in concrete bases, or <br />other suitable protection. The openings between the bottom of the fence and the ground or oth«* <br />surface shall not be more than four inches. <br />i
