THl’.’ farm Ar LONG LA* £ - 820 Brow*n Road North <br />Stjbdivision <br />P‘3ge 5 o f <br />I5-^ <br />I will be foivarding rhis material on'to the City Attorney and Engineer <br />and ask for coranents relating to the conditions which have not as yet <br />been ir.et. <br />I will be requesting some direction and clarification on the questionable <br />issues such as pedestrian easements, extent of use of casements - <br />overlapping casements - riparian rights - dock use and location - <br />provisions for changl-.g casement use or rights. <br />STAFF - March 10, 15 <br />Planning Commission trambers Gloria McDonald and Jo Ellen Hurr and staff <br />members Hank Muhich sid A1 Olson met with Tim Adams to resolve questionable <br />issues which were ad±ressed at the last Planning Commission meeting. <br />The most recently si±=citted data was reviewed. This included (1) City <br />Engineer Jim Olson's report dated March 8, 1978, (2) Developer's Engineer, <br />Bruce Kelly's, report dated March 3,1978, (3) Developer's purchase agreement <br />and riders, (4) Declaration of covenants, conditions, restrictions <br />and easements, (5) Desreloper's attorney, Steven Pflaum's letter to Bruce <br />Malkerson dated Marcx 7, 1978. <br />The questions raised ry the City Engineer were discussed. There appeared <br />to be an agreement trat most of these were technical issues which could <br />best be resolved by rae City Engineer. <br />Steve Pflaum's letter was also discussed. The Planning Commission <br />members were somewhat concerned whether these were conclusions agreed <br />upon and approved by the City Attorney. A1 Olson stated that the City <br />Attorney had approved and assured the members that he would obtain a <br />report to this effect before the Planning Commission meeting scheduled <br />for March 13, 1978. <br />The pedestrian access was left tinresolved. <br />PLANNING COMMISSION - March 13, 1978 l! <br />Tim Adams was present.i <br />The Zoning Administrstor introduced the latest material submitted by the <br />developer. <br />Jim Olson, the City rrglneer, added his comments with reference to his <br />report. A brief sunrrsry of his concerns were as follows: <br />1. Private roat - safety and erosion <br />2. Distinction between conservation and pasture easements - <br />potentially hazardous to runoff
