Mr, Gaffron stated <br />that pursuant to a memo of April 28, 1978 <br />Mrs. Konerza called Mr. Olson on May 5, 1978 <br />and stated they would withdraw the application <br />for variance and would send the City a letter <br />to that effect. <br />Mr. Hannah made a motion that this item be <br />tabled pending further input by applicant. <br />Motion seconded by Hammerel and unanimously approved. <br />Applicant Dennis Holmquist was present as well as <br />i^'e prospective buyer Kerry Gullickson. Applying <br />f‘. r Int area and lot width variances for construction <br />of a new residence on the subject property. <br />Mr. Gaffron noted a memo of May 4, 1978, showing <br />wetland area and permits for adjacent buildings. <br />Applicant has been unable to buy adjacent land <br />to make a larger lot. Planning Commission gave their <br />opinion that they would like to see a minimum 2-acre <br />lot in unsewered areas. Planning Commission also <br />wanted a legal opinion on whether prior subdivisions <br />must be honored even though code has changed, <br />Wilson made the following motion: That the Planning <br />Commission not approve this as a buildable site, <br />unless our village attorney's opinion is that this <br />is a grandfathered substandard building site and <br />in his opinion it is a legitimate building site. <br />If the lot is declared a building site, then the <br />normal building permit requirements of soil testing <br />and satisfactory evidence of legal access will be <br />required. Motion was seconded by Hannah and unanimously <br />carried. <br />Mr. Kerry Gullickson questioned whether or not two 2-1/2 <br />acre lots would be approved (i.e. acquisition of Bryant <br />Property). Planning Commission stated this would be <br />more acceptable. <br />Steve Wilson also requested that the following be <br />included in the meeting minutes: This issue of <br />the legal status of the grandfathered lot is the same <br />issue that came up two weeks ago in the Fartenwood <br />outlets.
