5. <br />6. <br />7. <br />and reconunended approval by a vote of 6 to 0. <br />4. The Planning Commission made the following findings of fact: <br />A. The proposed residence is set further from the lake than the old residence <br />B. <br />C. <br />The lot and adjacent lots are heavily wooded. <br />The proposed residence and lakeside pool will not obscure neighboring <br />properties views. <br />D.The proposed residence meets hardcover, lot coverage by structures and <br />height requirements. <br />E.The sewer line prohibits the proposed residence from being located further <br />back on the property (towards the road). <br />The City Council finds that the conditions existing on this property are peculiar to <br />it and do not apply generally to other property in this zoning district; that granting <br />the variances would not adversely affect traffic conditions, light, air, nor pose a <br />fire hazard or other danger to neighboring property; would not merely serve as a <br />convenience to the applicants, but is necessary to alleviate a demonstrable <br />hardship or difficulty; is necessary to preserve a substantial property right of the <br />applicants; and would be in keeping with the spirit and intent of the Zoning Code <br />and Comprehensive Plan of the City. <br />The City Council finds that granting a conditional use permit to allow land alteration <br />of more than 500 cubic yards of fill to be brought onto the property willTlot to be <br />detrimental to the health, safety or general welfare of the public, would not adversely <br />affect light, air nor pose a fire hazard or other danger to neighboring properties, nor <br />will it depreciate surrounding property values and that the proposed level of use of <br />the property will be in keeping with the intent and objectives of the Zoning Code and <br />Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City Staff, comments <br />Page 2 of 7 <br />■aw».
