CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Code Section 10.22, Subdivision 1(B) and Section 10.56, Subdivision 16(CX6) to permit an encroachment of 42' to construct a new residence on the property and 62 ’ to construct a lakeside pool into the average lakeshore setback; and a conditional use permit to allow land alteration of greater than 500 cubic yards to be brought onto the site per Section 10.03, Subdivision 19. Approval is subject to the following conditions: 1.Council approval is based on the site plan submitted by the applicant attached to this resolution as Exhibit A. Any amendments to the site plan may require itulher Planning Commission and City Council review. 2.The applicant shall submit a final grading plan to City Engineer for review prior to issuance of the building permit. 3.The applicant shall obtain a land alteration permit from the city prior to hauling fill to the site. 4.The applicant must contact Minnehaha Creek Watershed District for an erosion control permit. 5.Erosion control measure shall be taken by installing a silt fence around the construction area upon receiving permit from City and MCWD and priortb any land alteration activity. Applicants and their contractors shall follow the “Best Management Practices for Protection of Water Quality in Urban Areas.” 6.A route map shall be provided to the city prior to the start of construction showing which county/city street are to be used. 7.The applicant shall televise the sewer between the north and south lot lines prior to any grading activity and again after the project is complete.
