A RESOLUTION GRANTING A <br />VARIANCE TO SECTION 10.22, SUBDIVISION 1(B), <br />AND SECTION 10.56, SUBDIVISION 16(C)(6), <br />GRANTING A CONDITIONAL USE PERMIT <br />PER SECTION 10.03, SUBDIVISION 19 <br />FILE NO. 02>2853 <br />WHEREAS, Russell Schumer and Judy Florestano, (hereinafter "the applicants") arc <br />the owners of the property located at 955 Tonkawa Road within the City of Orono (hereinafter "the <br />City") and legally described as follows: <br />Lot 5, Block 1, Vasa Park, Hennepin County, Minnesota, (hereinafter “the property ”) <br />and <br />WHEREAS, the applicants have applied to the City for variances to Municipal Code <br />Section 10.22, Subdivision 1(B) and Section 10.56, Subdivision 16(CX6) to permit an encroachment <br />of 42* to construct a new residence on the property and 62’ to construct a lakeside pool into the <br />average lakeshore setback; and a conditional use permit to allow land alteration of greater than 500 <br />cubic yards to be brought onto the site per Section 10.03, Subdivision 19. <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on November 18,2002, at which tini? all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono. <br />FINDINGS <br />1. litis application was reviewed as 2^ning File #02-2853. <br />2. This property is located in the LR-1B Zoning District, where 1 acre is the minimum <br />lot area. The property consists of approximately 3.4 acres. <br />3.
