4.Both lots have been found to have adequate and suitable soils and approved sites for <br />on-site septic treatment facilities. <br />5.Driveway access for Lot 1 is via Outlot A with an opening from Fox Street. Lot 2 <br />has a separate opening from Fox Street. <br />6.A single family residence can be constructed on Lot 1 without the need for further <br />variances. <br />7.The existing residence on Lot 2 requires a setback variance to Outlot A. The <br />residence is located 30’ where SO’ is required. <br />8.Four accessory structures on Lot 2 will be removed prior to final plat approval. The <br />buildings to be removed are indicated on Exhibit A. <br />9.A garage, shed and three other accessory buildings are non-conforming requiring <br />setback and oversized accessory building variances. The accessory structures will be <br />removed when the Lot 2 is redeveloped. <br />NOW, THEREFORE BE IT RESOLVED, that based upon one or more of the <br />findings noted above, the City Council of the City of Orono hereby approves the preliminary plat for <br />Jeff Martineau on behalf of Cherry Stubbs per preliminary plat drawings by Mark Gronberg, Land <br />Surveyor, Coffin & Gronberg, Inc., Land Surveyors dated 6/28/02, revised 8-8-2002, subject to the <br />following conditions: <br />1.Subdivider shall pay the standard Park Dedication Fee and Stormwater Trunk Fees <br />per City ordinance for one additional building lot. <br />2.Dedication of drainage and utility easements S' along interior lines and 1 O' along the <br />perimeter boundaries. <br />Prior to residential construction on Lot 1, all preliminary and alternate septic sites <br />must be fenced off prior to any construction activities. <br />4.The City will grant the necessary variaiKcs to allow the existing house and non- <br />conforming accessory buildings to remain on Lot 2 until it is redeveloped at which <br />Page 2 of 7 <br />-------- <br />‘J
