Pertinent Code Sections: <br />Section 10.24, Subdivision 5 (B): Yard requirements. 10' side yard setback. <br />Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) (2): Allowed Hardcover. <br />Lot Area 75*250 ’ setback = 5,384 s.f. <br />Existing Hardcover = 2,822 s.f. (52.4%) <br />Proposed Hardcover = 2,942 s.f. (54.6%) <br />Review of Hardcover: <br />The hardcover numbers noted above do not reflect the amount of non-conforming landscaping <br />plastic on the property, which is a change from the percentages as noted on the hardcover calculation <br />worksheets. <br />Also, note the two rock gardens located in the 75-250 ’ setback are only considered 50% hardcover <br />based on the rock gardens are not impervious as the rocks are located over natural surface. Rather <br />than calculate the individual area of each rock the 50% figure was used to average the total hard <br />surface over each garden. <br />Issues for Discussion: <br />1.The property was developed prior to current zoning standards. The house is currently located <br />as close as T from the property line and gradually moves further from the property line as the <br />house gets further from the ltdee. The point where the new addition would join the existing <br />house is 8’ from the property line. The overhang from the house would be located <br />approximately 5’ from the property line, where an overhang cannot be located closer than 8.5’ <br />to a property line. <br />The addition increases overall hardcover on the property, however the total lot coverage by <br />structure would be below the 15% allowed by Code. Does the size of the house, relative to <br />the size of the lot, allow for certain hardcover alterations over 25% to permit the property to <br />maximize overall structure (14.6%)? <br />3.The addition will create 120 s.f more hardcover on the property than preexisting conditions. <br />Should an equal amount of hardcover be removed to compensate for the additional <br />hardcover? <br />Proposed lot coverage by structures is as follows: <br />House 1,418 s.f <br />Shed 85 s.f <br />Total 1,503 s.f / 10,282 = 14.6% <br />«0l-2699 hy and Kendall Nygard <br />1386 Rest Point Road <br />Januaiy 22.2002 <br />Pate 2 of 3 <br />L.fcjtunrkMCarra-
