The applicants are proposing to <br />construct an addition to the existing residence. The addition consists of an attached 2 stall garage <br />with a bedroom above it. The garage is the same level as the existing basement. The new bedroom <br />will be on the first floor above the garage. The applicants are also proposing to construct a deck to <br />the lake side of the residence. <br />The subject property is a comer lot. In this case, average lakeshore setback is determined by <br />measuring the distance of the residences from the ordinary highwater mark of the lake for both <br />properties, rather than the straight line between the most lakeward protmsions of the residence <br />buildings. If one of the residences is closer to the OHWL, as in this case, average lakeshore setback <br />is an issue. The adjacent residence to the south is a comer lot also, and is oriented with its driveway <br />off North Shore Drive. These two residences were used to determine the average lakeshore setback <br />for the property (See Exhibit E). <br />Pertinent Code Sections: <br />1. Section 10.22, Subd. 1 (B)and Section 10.56, Subd. 16(C)(6): Average Lakeshore Setback: The <br />average lakeshore setback line shall be a straight line connecting the most lakeward protrusions of <br />the residence buildings on the immediately adjacent lakeshore lots.
