Application Deadline: 1/8/2003 <br />60 Day Deadline: 3/9/2003 <br />Extension: 5/8/2003 <br />REQUEST FOR COUNCIL ACTION <br />Department Approval: <br />Name: Jennifer Chaput <br />Title: City Planner <br />APR 2 6 2003 <br />Cn Y UH OHOivu <br />DATE: April 23,2003 <br />ITEM NO. .5 <br />Agenda Section: Zoning <br />Item Description://02-2859 Blake & Mar>' Bichanich <br />332 Westlake Street <br />Variances <br />Exhibits: <br />A Resolution <br />Application Summary ’: <br />The applicants initially requested the following variances in order to construct a new house in the same <br />location as a house exists today: <br />1. side yard setbacks: 11’ to the south and 19.3 ’ to the north where 30 ’ is required; <br />2. lot width: 100.28 ’ where 200' is required; and <br />3. lot area: 1.34 acres (58.659 s.f.) where 2 acres (87,120 s.f.) are required. <br />A recommendation regarding this application was made by the Planning Commission at their January <br />22, 2003 meeting to approve the application as presented, with an alteration of the side yard setbacks to <br />not less than 20 ’ on each side with up to 4' overhang encroachments. <br />The City Council heard the Planning Commission ’s recommendation on March 10. 2003. Staff <br />recommended denial of the side yard setback variances to both the Planning Commission and the City <br />Council because new const."action was being proposed and the required setbacks could be met. The <br />City Council tabled the application on March 10, 2003 to allow the applicants to meet with staff to <br />further discuss the requested side yard setback variances. <br />fhe applicants revised »heir proposal to request approval of 20 ’ side yard setbacks per the Planning <br />Commission ’s recommendation and presented it to the City Council at their meeting on April 14. 2003. <br />1 he City Council was unable to identily a hardship to permit substandard side setbacks for new <br />construction. The City Council approved the lot width and lot area variances and denied the requested <br />variances for side yard setbacks. This same application can not be resubmitted for a period of six <br />months from the date of denial. <br />COUNCIL ACTION REQUESTED: <br />To adopt or amend the enclosed resolution.
