A RESOLUTION GRANTING LOT AREA AND WIDTH VARIANCES <br />AND DENYING SIDE SETBACK VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.23, SUBDIVISION 6 <br />FILE NO. 02-2859 <br />WHEREAS, Blake and Mary Bichanich, husband and wife, (hereinafter "the <br />applicants") are the owners of the property located at 332 Westlake Street, within the City of Orono <br />(hereinafter "the City") and legally described as follows: <br />LOTS 4 & 5, BLOCK 1, HILLSIDE PARK, Hennepin County, Minnesota, <br />(hereinafter “the property"); and <br />WHEREAS, the applicants have applied to the City for variances to Municipal <br />Zoning Code Section 10.23, Subdivision 6 to allow construction of a new home oi; a 1.34 acre lot <br />where 2 acres are required with a lot width of 100.28’ where 200’ is required and side setbacks of <br />1 r to the south and 19.3 ’ to the north where 30 ’ is required in the LR-1A zoning district; and <br />WHEREAS, after due published notice and mailed notice in accordance with <br />Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on January 22, 2003, at which time all persons desiring to be <br />heard concerning this application were given the opportunity to speak thereon. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono. <br />FINDINGS <br />1. <br />•> <br />This application was reviewed as Zoning File #02-2859. <br />The property is located in the LR-1 A Zoning District, uliere 2.0 acres are the <br />minimum required lot area. The property consists of approximately 1.34 acres. <br />3.The Orono Planning Commission reviewed this application on January 22, 2003 <br />and recommended approval by a vote of 6 to I to permit construction of a new home <br />on a 1.34 acre lot where 2 acres are required with a lot width of 100.28’ where 200’ <br />Page 1 of 5 <br />1^:
