Hennepin Countv Transportation Planning <br />Hennepin County has reviewed the proposal and supports the proposed location of the access to <br />the property. The County states that there is a sight distance problem westbound on County Road <br />6 (Sixth Avenue N) so it is most desirable to have the access to the property located as far away <br />from the County road as possible. <br />Minnehaha Creek Watershed District <br />The application has been reviewed by the Minnehaha Creek Watershed District. They note that <br />an erosion control permit will be required and that a site plan showing contour elevation lines <br />will be required as part of their submittal. Board of Managers Approval will be required before a <br />permit is issued. <br />History: <br />The property in question was created in 1976 (Registered Land Survey #1418) as part of a five <br />lot subdivision, accessed through a drivew'ay (Tract E). All of the lots have been developed to <br />date, with the exception of 1580 Sixth Avenue N. The resolution of the subdivision docs not <br />identify any development stipulations on the land. The subdivision allowed for Tract E to cross <br />Long Lake Creek and did not identify any designated wetlands at that time. <br />In 1994, the owners of the property to the north, 1570 Sixth Street N (Lot A), were granted <br />variances and a CUP (Zoning File # 1881) to permit construction of a private driveway to cross a <br />protected tributaiy' to access the back of the owners ’ property. The variances included: filling and <br />grading within 26’ of the flood plain and wetland conservation area; grading and filling w ithin <br />75’ of a tributary; and placing hardcover w ithin 75’ of a tributary. The CUP w as granted for <br />grading and filling in excess of 500 cubic yards in a shoreland district. <br />Hardship: <br />The applicant has included their statement of hardship in Exhibit B. The applicants should also <br />be asked for their testimony regarding this issue. <br />Issues for Consideration: <br />1 . The lot was created in 1976 and is permitted to have one access; <br />2. The minimal amount of frontage on Tract E requires that the access be located close <br />to the tributary on Sixth Avenue N; <br />3. City staff have determined that the safest location for access to the lot is as far away <br />from Sixth Avenue N as possible; <br />4. Driveways can not be located closer than 5' to any (side) lot line and grading may not <br />occur w ithin this area; <br />5. The construction of the access will create minimal disruption of the land and should <br />not negatively impact the tributary; <br />6. Testing has not been completed to date to determine the location of the primary and <br />secondarv septic sites on *he property for when it develops. The location of the septic <br />sites will affect where the driveway is located on the property in the future; <br />7. Other issues raised by the Planning Commission. <br />U0i-2H68 John E.
