•04-3002 <br />May 17,2004 <br />Pace 3 of 4 <br />The two t.ecs currently within the 0*75’ zone, at the very top of the slope and 75’ <br />line, can be removed as long as tree replacement is included in the restoration <br />plan due to their vulnerability during the construction process. <br />The revised application will be referred back to the Planning Commission for <br />their recommendation. <br />The applicants will grant an easement to the City for sewer maintenance purposes, <br />and <br />The applicants can submit for building permit for the new residence while the <br />slope restoration project is in its review stages, as all other Zoning Ordinance <br />requirements can be met. <br />The application was brought before the City Council at their April 26, 2004 meeting for <br />an informal discussion on whether the Council agreed with the Planning Commission’s <br />recommendation to remove the boathouse. The City Council did agiee with the Planning <br />Commission’s recommendation and also the details bulleted above. Tire application has <br />now been forwarded back to the Planning Commission for review of the bank restoration <br />plan, where the boathouse should again be denied as part of a condition of approval. <br />At present, the City has located and staked the sewer line, which is located approximately <br />1 foot off the front line of the boathouse, and 6 to 6.5 feet deep. Due to the close <br />proximity of the line to the boathouse, the Public Works department has requested that <br />they be informed of the date of demolition and that they be present. At this time staff and <br />the Public Works department will verify if lire 5’ setback from the sewer line is adequate, <br />or if a greater or lesser distance would be appropriate. Staff will include this as a <br />condition of any conditional use pennit approved for land alterations. <br />Conditional Use Permit Analysis <br />Zoning Ordinance Section 78-1250 lists several evaluation criteria that must be <br />considered when reviewing an application for a conditional use within the Shorcland <br />Overlay District. The evaluation criteria are as follows with staffs response: <br />a.The prevention of soil erosion or the possible pollution of public waters, both <br />during and after construction. <br />The applicants are proposing to install a silt fence 5 ‘ in from the staked sewer <br />location, which, is about 10' from the 929.4' elevation. No activity will be <br />allowed outside the silt fence except for re-vegetation of the area where the <br />boathouse sat. Staff feels this is adequate distance for the prevention of soil <br />erosion and the possibility of pollution to the lake. <br />b.The visibility of structures and other facilities as viewed from public waters is <br />limited. <br />The applicants have proposed plant materials which, over time, will screen the <br />retaining walls as viewed from the lake. <br />c.The site is adequate for water supply and on-site sewage treatment. <br />N/A <br />jdya
