For this property, 3 4-acre+ lots are being created. Each would be <br />charged a fee of (4.0 acres x $2,700 = $10,800 x 3 lots = $32,400 for a total fee). <br />Tree Preservation <br />The applicant has not submitted a tree preservation plan but has indicated that a private <br />tree preservation covenant will be established under the title of all three lots. The Zoning <br />Ordinance doesn ’t regulate tree preservation thus staff is satisfied with the applicants <br />willingness to establish covenants privately. <br />Archaeological Impacts <br />The only historically significant features on the property, known to staff, are the entrance <br />monuments, gates, and wall located at the read frontage. The applicants are proposing to <br />preserve these features. If the applicant has not already done so, the State Historical <br />Preservation Office (SHPO) should be contacted to inquire as to the need for an <br />archaeological review to determine the possibility of American Indian burial mounds. <br />Sewage Treatment <br />Copies of the proposed septic plans were submitted with the preliminary plat. Septic <br />inspector Matt Bolterman has reviewed the proposed septic plans and his comments can <br />be found in the attached memorandum dated, March 25, 2004 (Exhibit E). He is <br />recommending approval of the proposed septic systems, although proposed lots 1 and 2 <br />should make every effort to utilize the septic sites on the street side of the proposed home <br />rather than the lake side. Proposed lot 3 will be forced to use the septic sites on the lake <br />side of the proposed home location due to the topography not yielding any other <br />acceptable sites. It should be noted that all the sites shown on the plan meet both city and <br />state requirements. <br />The property is within the MUSA and staff is exploring the potential of providing sewer <br />to the property. Elimination of septic systems would provide greater site flexibility. <br />Park Dedication <br />The property does not abut any public roads except at the very NE comer and does not <br />abut any of the existing or proposed public trails shown on the City’s Comprehensive <br />Trail Plan. A future trail is planned along the public portion of Fox Street. This <br />subdivision proposal will be submitted to the Park Conunission for their review in early <br />May, to determine whether land dedication is required or merely a park fee for the two <br />new lots (Park Fee would be $5,550 per lot). <br />Interim Period <br />Plaiming Department staff have spoken to a potential buyer of proposed lots 2 and 3. <br />This potential buyer has indicated that the existing house will be lived in for a period of <br />time until a new house on lot 2 is constructed (lot 3 will remain vacant). Because the <br />current mound (new in 1996) for the septic system overlaps onto lot 1. and because the <br />potential buyer doesn ’t want to be forced to remove that system until a new house is <br />built, the Planning Commission should consider allowing a temporary easement over the <br />4.
