Staff does not find this to be <br />problematic assuming the easement automatically expires at a defined time ^proved by <br />the City. It should be noted however, the driveway locations for lots 1 and 2 may force <br />removd of the mound earlier than construction of a home on lot 1. The Planning <br />Commission should discuss if they are comfortable allowing a temporary easement, <br />approved by the City, until any site grading occurs (including a driveway for lot 1). <br />Issues for Consideration <br />1. Should the applicants be required to use the septic site located on the street side of the <br />proposed house pads rather than the sites on the lake side even though they meet state <br />standards? <br />2. Should proposed lot 3 be required to use the existing driveway that exists outside the <br />private gates of Fox Street? <br />3. Should a temporary easement, during the interim period, be permitted for the cunent <br />mound overlapping onto proposed lot 1? <br />4. Are there any other issues or concerns with this application? <br />Staff Recommendation <br />Staff recommends approval of the preliminary plat with the following stipulations: <br />1. Only two new driveways are proposed on the private section of Fox Street and <br />proposed lot 3 must use the existing driveway that exists outside the Fox Street gates. <br />2. Proposed lots 1 and 2 iftliHlt^utilize the septic sites on the street side of the proposed <br />house pads rather than the lake side sites. <br />3. The average lakeshore setback line shown on the preliminary plat shall be the line <br />used to determine the average lakeshore setback for all 3 lots, not an average setback <br />that is determined by when which lots construct houses. <br />4. If the existing mound is proposed to stay during the interim period, a temporary <br />easement, expiring at the time of site grading for proposed lot 1, may be permitted but <br />only by approval of the City. <br />5. Implementation of the recommendations of the City Engineer. <br />6. Implementation of the recommendations of the Miwehaha Creek Watershed District. <br />7. Submission and approval of the fmal plat. <br />8. Payment of standard fees and dedication of required easements. <br />9.
