The deck extends 5’ into the required 7S ’ lake <br />setback. The portion of the deck located within the lake setback Is S*xl2’ (60 s.f.). <br />Hardcover Variance <br />Currently the property has 43.1% hardcover within the 7S ’-250’ zone where 25% is <br />allowed. The deck accounts for 2.1% of the hardcover within this zone where previously <br />there was no hardcover. <br />Within the 0-75 ’ zone there is a total of 60 s.f. of hardcover where none is jdlowed. The <br />deck accounts for all of this hardcover (1.14%). <br />Hardship Statement <br />Applicants have completed the Hardship Documentation Form (Exhibit B), and should be <br />asked for additional testimony regarding their application. <br />Hardship Analysis <br />In considering applications for variance, the Planning Commission shall consider the effect of the <br />proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic <br />conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property In <br />the surrounding area. The Planning Commission shall consider recommending approval for variances <br />from the literal provisions of the Zoning Code In Instances where their strict enforcement would cause <br />undue hardship because of circumstances unique to the Individual property under consideration, and <br />shall recommend approval only when It is demonstrated that such actions will be In keeping with the <br />spirit and Intent of the Orono Zoning Code. <br />Staff finds that, absent the documentation of the old deck, there is no hardship for the size <br />or location of the new deck.
