Sv. <br />Zoning File #1779 <br />November 6, 1992 <br />Page 4 <br />maintained by the City) be assessed equal amounts for the <br />improvements which would include pavement to a 28' width and an <br />80' paved diameter cu‘1-de-sac. <br />Impact of Additional Right-Of-Way Request <br />Dedication of additional right-of-way for road and cul-de- <br />sac has the impact of reducing the area of both Lots 1 and 2. <br />Lot 1 reduces from 2.01 acres dry buildable to 1.86 acres dry <br />buildable. Lot 2 decreases from 1.00 acre dry buildable to 0.92 <br />acre dry buildable^ although credit for Flood Fringe might <br />increase this to 0.96 acre. <br />Further, the dedicated cul-de-sac as sketched by the <br />Engineer would be approximately 35' from the existing residence <br />on Lot 2, where 50' is required in the RR-IR zone, and would <br />require extensive filling to the rear of the existing garage. <br />Moving the cul-de-sac 15' west to yield the proper house setback <br />would leave only a 10' setback to the drainfield sites. <br />Finally, the additional 20* of right-of-way has a <br />significant impact on the alternate tested drainfield site, which <br />would now abut the new right-of-way rather than maintaining the <br />required 20' setback. Additional testing has not been provided <br />to verify whether drainfield sites could be developed while <br />maintaining appropriate setbacks. <br />The Community Management Plan considers Orono Orchard Road <br />as a "Scenic Parkway", requiring a 50-66' right-of-way, and this <br />portion of Fox Street as a "Local Street" requiring a 50' - 60' <br />right-of-way. Since applicant's ownership is to the centerline <br />of Orono Orchard Road, it was suggested that something less than <br />33' be dedlcataed for it. A 17' dedication would leave 16' x <br />410' > 0.15 acre within Lot 1, just about offsetting the Fox <br />Street dedications (Engineer would have to determine whether City <br />needs all 33', only 17', or something in between, although 33' <br />would be a consistent requirement). <br />Road Dedication Considerations <br />Planning Commission should consider the following questions: <br />Given the potential impact of development of a cul-de- <br />sac and widened roadway, is there justification to <br />rant area variances to the 1 acre/2 acre requirements <br />n order that this property can be subdivided?! <br />Absent an upgrade of Fox Street to City standards, <br />should the City continue to maintain this section of <br />Fox Street as a public roadway?
