’ i' <br />Zoning Code Amendment <br />February 10, 1992 <br />Page 2 <br />Shoreland Management Ordinance Highlights <br />The Shoreland Management Ordinance will constitute an <br />entirely new section. Section 10,56, within the zoning code. A <br />number of definitions not appearing elsewhere in the zoning code <br />are added for clarity, and existing definitions within various <br />sections of the zoning code and subdivision code are revised as <br />necessary to eliminate inconsistencies. A number of new <br />concepts, such as "bluff", "bluff impact zone", "shore imoact <br />zone", and "water-oriented accessory structure or facility", are <br />introduced for the sake of compliance with DNR regulations. <br />Because Orono has defined lakeshore zoning districts and a <br />number of restrictive controls already in place, it was <br />determined that creation of a Shoreland Overlay District was the <br />most appropriate method to effectuate the necessary ordinances <br />without compromising the integrity of the current code structure. <br />The lakes which define the extent of the Shoreland Overlay <br />District are classified either as General Development (GD), <br />Recreational Development (RD) or Natural Environment (NE). The <br />District includes lands within 1,000 feet of the Ordinary High <br />Water Level (OHWL) of these defined lakes, as well as lands <br />within 300 feet of designated tributary streams. The City <br />contracted with Barr Engineering to provide supportive data to <br />assist the DNR in determining the OHWL foi Lake Classen, Dickey <br />Lake, and Lydiard Lake, for which no OHWL had previously been <br />defined. Additionally, the DNR defined the OHWL for French Lake. <br />Three tributary streams within Orono were initially <br />designated as protected waters by the DNR. These include <br />Painters Creek, Wolsfeld Creek (entering the north side of Long <br />Lake from sources in Medina) and Long Lake Creek (between Long <br />Lake and Tanager Lake). The Lake Use Committee has recommended <br />adding Stubbs Bay Creek (between Lake Cl-asen and Stubbs Bay) and <br />Dickey Lake Creek (between Dickey Lake and Long Lake) as <br />protected waters subject to the Shoreland Regulations. <br />The ordinance provides for notification of the DNR whenever <br />variances, conditional use permits or amendments are being <br />considered that affect the Shoreland Overlay District. <br />Perhaps the most significant portion of the Shoreland <br />Management Ordinance is Subdivision 16, The Shoreland Overlay <br />District Standards. These standards apply to the use and <br />development of all property in the District, and are summarized <br />as follows: <br />- Minimum lot area and width standards generally exhibit <br />no change from existing codes. <br />i <br />----
