I f <br />! <br />\ <br />I- ■: <br />A RESOLUTION GRANTING A <br />LOT AREA VARIANCE AND <br />CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTIONS 78-330 (B), 78-967 (B) (2), <br />AND SECTION 78-1286 (D) (2) <br />RLE NO. 05-3141 <br />WHEREAS, Jeffrey P. Gustafson and Ethel M. Gustafson, husband and <br />wife (hereinafter “the applicants**) are the owners of the property located at 4203 North <br />Shore Drive within the City of Orono (hereinafter the “City*’) and legally described as <br />follows: <br />Part of Lot 3, Orchard Beach. Hennepin County, Minnesota, (hereinafter the <br />“property**); and <br />WHEREAS, the applicants have made application to the City of Orono <br />for a lot width variance and a conditional use permit for fill in excess of 500 cubic yards <br />per Orono Municipal Zoning Code Sections 78-330 (B), 78-967 (B) (2), 78-1286 (D) (2) <br />to allow construction of a new residence on an existing lot which has %* in width at the <br />shoreline and 117* in width at the 75* setback where 140* in width at both the shoreline <br />and at the 75* setback is normally required, and to incorporate approximately 770 cubic <br />yards of fill into the street side of the property. <br />NOW, THEREFORE BE IT RESOLVED by the City CouncU of <br />Orono, Minnesota: <br />nNDlNGS <br />1. <br />2. <br />This iqiplication was reviewed as Zoning File 05-3141. <br />The property is located in the LR - IB, Zoning District which requires a <br />minimum lot area of 1.0 dry acres and a minimum lot width of 140 feet. <br />3.The Pluming Commission reviewed this qipl'ca^on at a public hearing <br />held on August 15, 2005 and recommended approval of the lot width <br />vtfiance and conditional use permit based on the following findings: <br />Page 1 of S <br />1
