The lot is a legal lot of record created prior to adoption of the current <br />Zoning Ordinance nunimum area and width lot requirements. The <br />property is l.OS acres in area and has 90’ in width at the shoreline and <br />117’ in width at the 75 ’ setback. <br />b. The proposed residence meets all other Zoning Ordinance <br />requirements with respect to setbacks, lot coverage by structures, <br />hardcover, and building height. <br />c. The lot is provided with City sewer. <br />d. The applicants are not able to acquire additional property to meet <br />minimum lot width requirements. <br />e. The applicants are relocating the driveway and eliminating the shared <br />driveway situation with the property to the east. <br />f. The request for fill in excess of 500 cubic yards will not impact die <br />Property as viewed from the lake. <br />g. The adjacent properties will not be negatively impacted by the <br />proposed fill. <br />h. The amount of fill proposed will not result in a net increase in the <br />amount or rate of storm water being directed to the adjacent eastern <br />property in excess of current levels. <br />The City Council has considered this application including the findings <br />and recommendation of the Planning Commission, reports by City staff, <br />comments by the applicants and the public, and the effect of the proposed <br />variance and conditional use permit on the health, safety and welfare of <br />the community. <br />The City Council finds that the conditions existing on this property are <br />peculiar to it and do not apply generally to other property in this zoning <br />district; that granting the variance and conditional use permit would not <br />adversely affect traffic conditions, light, air nor pose a fire hazard or other <br />danger to nei^boring property; would not merely serve as a convenience <br />Page 2 of S <br />------iim
