A RESOLUTION APPROVING A <br />SUBDIVISION OF A LOT LINE REARRANGEMENT AND <br />CREATION OF AN INGRESS/EGRESS EASEMENT <br />FOR PROPERTIES LOCATED AT <br />825 OLD CRYSTAL BAY ROAD SOUTH <br />FILE 805-3160 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, the City Council of Orono (hereinafter “City Council") has adopted <br />subdivision regulations for the orderly, economic and safe development of land within the City; and <br />WHEREAS, the City Council has considered the application for a subdivision of a <br />lot line rearrangement by Judson M. Dayton (hereiiuifter “the applicant”) of three properties known <br />by PIN No.s 09-117-23 21 0001; 09-117-23 21 0004; and 09-117-23 21 0005, said properties legally <br />described as: <br />EXHIBIT A, attached (hereinafter “the properties”); and <br />WHEREAS, after due published and mailed notice in accordance with Minnesota <br />Statutes 462.358 et. seq. and the City of Orono Zoning and Planning Codes, the Orono Planning <br />Commission held a public hearing on October 17, 2005 at which time all persons desiring to he <br />heard concerning this application were given the opportunity to speak thereon; and <br />WHEREAS, the applicants have completed or have agreed to complete all <br />requirements of the City for a metes and bounds combination and subdivision of a lot lino <br />rearrangement, resulting in the conversion of the three parcels into two parcels, hereinafter referred <br />to as Proposed Parcel 1 and Proposed Parcel 2, as shown on the survey attached as Exhibit “B”; <br />resulting in a new legal description for each of the two new parcels as shown in Exhibit “B”; and <br />resulting in the creation of an access easement for ingress and egress to Proposed Parcel 2 over <br />ProDosed Parcel 1; and <br />WHEREAS, the City Council has considered the implications of requiring this <br />combination/division to be a plat, and has determined that the conversion from three lots to two lots, <br />while resulting in a lot that could be defined as a back lot, does not result in any new building sites; <br />and <br />Page 1 of3 <br />|! <br />¥ <br />I
