WHEREAS, the City Council has reviewed the proposed ingrcss/cgrcss easement to <br />provide legal access firom Old Crystal Bay Road South to Proposed Parcel 2, and has determined that <br />the language of said easement does not have negative implications for future development of <br />Propos^ Parcels I and 2. <br />NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of <br />Orono hereby approves the lot line rearrangement of the above referenced property by the applicant <br />as shown on the Certifleate of Survey by Mark S. Gronberg, a licensed surveyor of Gronberg & <br />Associates, Inc. dated September 20, 2005, attached hereto as Exhibit "B”, and approves the <br />proposed ingress/egress easement attached hereto as Exhibit '‘C”, subject to the following conditions: <br />1.Applicant shall provide a title opinion for the properties confirming ownership and <br />encumbrances. <br />2.Applicant shall provide for attaenment to this Resolution a copy of the aforesaid survey <br />signed by all parties with a legal interest in the Properties. <br />3.Nothing in this approval shall be construed as granting variances to setbacks, hardcover or <br />other building location, lot size or development standards established by the City of Orono. <br />4.This lot line rearrangement does got constitute a subdivision that would trigger expiration of <br />the existing bam caretaker apartment conditional use permit as granted in Resolution No. <br />3072; does not affect the area of property associated with the horse bam which was granted <br />an Oversize Accessory Structure conditional use permit in Resolution No. 3072; and does not <br />require the removal of existing structures within the property. <br />5.The aforesaid division shown on the attached Certificate of Survey shall be fried by the Citv <br />of Orono with either the Hennepin County Recorder's Office or Registrar of Titles Office on <br />or before May 14,2006 together with a certified original copy of this resolution. <br />6.The approval granted by this resolution shall expire if the division has not been filed by the <br />date specified above. In that event, it will be necessary to file a new application with the City <br />of Orono for subdivision review. <br />Page 2 of3
