<br />4. Maintain the pond and associated drainage structures to perpetuate their function as designed.
<br />Maintenance will include inspection, cleaning, and repair of drainage structures, maintenance of
<br />erosion control measures, maintenance of the turf around the pond, and pond sediment removal;
<br />and
<br />5. Perform all necessary maintenance of vegetation and landscaping within the bridges’ right-of-way
<br />at the bridge approaches and within pond right-of-way. Including necessary and regular mowing,
<br />tree, shrub, and flower maintenance, noxious weed control, and litter or debris collection and
<br />disposal.
<br />C. The City will provide for all maintenance and reconstruction as needed on Trail B described in Section
<br />I, Paragraph A in accordance with the standards and guidelines the City uses to maintain and operate
<br />its trail systems and will Include but is not limited to the following:
<br />1. Maintain the trail to keep ft In good repair and free from obstructions and imp^iments that may
<br />interfere with the passage of bicycle and pedestrian traffic. Maintenance will include all
<br />necessary maintenance to preserve the trail and its associated drainage structures, ditches, arid
<br />right-of-way in their present condition, including patching, overlay, or mill and overlay of the trail
<br />surface, Joint and crack sealing of the trail surface, aggregate shoulder repair, replenishment, and
<br />grading, slope repair, drainage structure cleaning and repair, graffiti removal, fence repair, ditch
<br />cleaning, sweeping, and litter and debris collection and disposal; and
<br />2. Use snow and ice control measures to keep the trail reasonably free and dear from snow and ice
<br />and undertake proper and timely cleaning when necessary; and
<br />3. Perform all necessary maintenance of vegetLiion arid landscaping within the trail right-of-way
<br />induding necessary and regular mowing, tree, shrub, and flower maintenance, noxious weed
<br />control, and litter or debris coHection and disposal: and
<br />4. Reconstruction of the trail and assodated drainage structures if necessary.
<br />D. Administer, issue, regulate, and insped transportation permits, adopt-a-highway permits, and permits
<br />to maintain existing utilities on the bridges, pond, and trail described in SecUon I, Paragraph A; and
<br />E. The City will comply with all Railroad notification, access, and safety requirements before, during, and
<br />after any maintenance activity.
<br />F. The City will furnish all labor, equipment, materials, supplies, tools, and other items necessary for the
<br />maintenance activities provided by the City under this Agreement.
<br />G. The City will hold State harmless from any liability due to City's maintenance o*. or failure maintain as
<br />described in Section I. Paragraphs B and C, the bridges, pond, and trail described in Section I.

<br />II. DUTIES OF STATE
<br />A State is responsible for any extraordinary maintenance, bettennents con^Tuciion or reconstruciion
