Mn/DOT Agreement No. 85231 <br />WHEREAS, State is about to perform construction of the new Trunk Highway 12 alignment within and <br />adjoining the corporate City limits, in accordance with State prepared plans, specifications, and special <br />provisions, for which the project has been designated State Project No. 2713-75; and <br />WHEREAS, State and City are empowered to enter into agreements pursuant to Minnesota Statutes <br />Section 471.59; and <br />WHEREAS, pursuant to Minnesota Statutes, Section161.38. the parties desire to enter into an agreement <br />relating to the maintenance of certain Trunk .lighway 12 bridges, pond, and trail within and adjoining the <br />corporate City limits upon the terms a: id conditions set forth in this Agree lent; and <br />NOW, THEREFORE. THE PARTIES AGREE AS FOLLOWS <br />I. PUT lES OF CITY <br />A. Upon State's completion of the new Trunk Highway 12 alignment consL-uction to be performed under <br />the construction contract, the City will provide for the maintenance as defined in Section I. Paragraph <br />B without cost or expense to the State, on those bridges, pond, and trail located within and along <br />Trunk Highway 12 right-of-way and alt facilities a part thereof as shown in Exhibits A though D. which <br />are attached and incorporated into this agreement, particularly described as follows: <br />1. Bridge Number 27275 (Old Crystal Bay Road) as shown in Exhibit A; and <br />2. Bridge Number 27274 (Willow Drive) as shown in Exhibit B; and <br />3. Spruce Pond as shown in Exhibit C; and <br />4. Tran B from the west City limits to the intersection with the Luce Line Trail as shown in Exhibit D. <br />B. The City wiH provide routine maintenance on the bridges and pond described in Section I, Paragraph <br />A in accordance with the standards and guidelines the City uses to routinely maintain its bridges and <br />ponds and will indude but is rot limited to the following; <br />1. Maintain the bridges to keep them in good repair and free from obstructions and impediments that <br />may interfere with the passage of vehide, bicycle, and pedestrian traffic. Maintenance will <br />include all necessary routine maintenance to preserve the bridges and their associated drainage <br />stiuctures, ditches, sidewalks, and right-of-way in their present condition, induding the proper and <br />timely cleaning and flushing of bridge deck drains, necessary deck spall patching with material <br />approved by the Mn/DOT Metro Bridge Maintenance Office, minor bridge railing repair, proper <br />and timely sealing of cracks in the bridge wearing surface, removal of graffiti if it is easily <br />accessible from the top of the bridge without the use of specialized equipment and does not <br />require any work or equipment on Trunk Highway 12, architectural treatment and appurtenance <br />cleaning and repair, minor painting, proper and timely repair of the expansion joint glands, <br />replacement of light fixtures, luminaries, and electrical wiring, minor slope paving maintenance, <br />and proper and timely sweeping of the bridge surface and sidewalks; and <br />2 Use snow and ice control measures ** keep the bridges reasonably free and clear from snow and <br />ice and undertake proper and timely c' aning when necessary. Bndge snow and ice removal will <br />cover the entire bridge width without pushing snow or ice onto any roadway, railroad, trail, path, <br />or walkway located below the bridge; and <br />Maintain the bridges signing, traffic control devices, safety devees. and decorative <br />enhancements suen as guardrai'. attenuators signals and lighting systems, pay an associaieo <br />utility bills, and provide such bridge wearing surface and sidewalk markings and lane striping as <br />may be necessary; and <br />.‘‘hue.
