IJ.
Memorandum
Date:
To:
OOUNCIL MEETING
non 42006
CfTYCFORORT"
From:
RE:
November 10,2005
City Administrator
Mayor
Members of the Council
Janice Gundlach, City Planner^
Appeal -1535 Bolin*s Point Road - Gate Height Interpretation
Attachments
A - 11 >10^5 Letter firom Paul B. Zisla
B - 9-12>0S Council Minutes
C - 9«8^S Council Memo
At the 9> 12*05 Council meeting, the Zoning Ordinance a{^>eal regarding the gate height
restrictions at 1535 Bolin’s Point Road was tabled. The purpose of the tabling was to
allow the Couik U to discuss the issue in a non*biased manner, as consideration of
amendments to the Zoning Ordiiuuice were suggested by City staff. The Council
discussed this issue at a work session on 9*27*05 and has directed staff to move forward
with amendment language clarifying gate height restrictions, when in accordance with
entrance monuments. This amendment language was discussed by the Plaiuiing
Commission at a work session on 11*2*05 and a public hearing will be formally held on
11*21*05.
The matter of the Ordiiuuice language appeal remains open. The manufacturer of the
gates, Simply Automation not Beaver Landscaping, has obtaiiied an attorney who has
submitted a letter requesting that the gates be considered an appurtenance to the
monuments, which are permitted a height of 8 feet. The City Anomey has been
consulted on this argument and will provide direction to the Council at the meeting.
/ • ’•-y-
Wlr
