Hard cover limitations, (a) No hard cover or impervious surface shall be <br />placed, located or constructed within 75 feet of the ordinary high water level of any lake <br />or tributary, except for stairways, lifts, landings and lockboxes as regulated elsewhere in <br />this Code, (b) Between 75 feet and 250 feet of the OHWL, there shall be no greater than <br />25 percent hard cover. Between 250 feet and 500 feet of the OHWL there shall be no <br />greater than 30 percent hardcover. Between 500 feet and 1,000 feet of the OHWL there <br />shall be no greater than 35 percent hardcover. <br />Sec. 78-1279. Placement of structures on lots. (6) Average lakeshore setback. No <br />principal or accessory structure shall be located closer to the lakeshore than the average <br />distance from the shoreline of existing residence buildings on adjacent lots; except that <br />tliis does not apply to stairways, lifts, landings and lockboxes. Following staff review of <br />the building permit application it became apparent that the second story was a third story <br />due to the amount of foundation exposed on the lowest level. At that time the applicant <br />met with Planning Department staff and the City’s Building Inspector to di.scuss the <br />building code definition of ba.sement and also the Zoning Ordinance’s definition of <br />building height and half story. Tlie applicant has since revised the plans to incorporate <br />the basement as the first floor and is proposing a new half story above the existing second <br />.story, for a total of 2 and '/j stories.
