If <br />#05-3083 MUSA Anicndniciil! <br />February 17, 2005 <br />Page 2 <br />25 Soulli Brown Road MUSA Expansion <br />This is an existing developed properly located on Brown Readjust south of Watertown Road with a <br />failing septic system. I'he house was constructed in 1940, and the eonstruction date and details of <br />the septie system arc unknown. The property is 3.0 acres with 1 .5 acres of filled or disturbed soils <br />unsuitable for septic with the remainder wooded. This property is in the 2.0 acre zoning district. <br />In 1999, when the Fox Ridge area was sewered, a pressure sewer line was installed along Brown <br />Road from the Fox Ridge neighborhood north to connect to an existing Long Lake sewer line at <br />Watertown Road. At this time, sewer service was offered to the existing developed properties along <br />Brown Road that were adjacent to the sewer. These properties were eligible for sewer using a pool <br />of 50 sewer units that were granted to the City in 1994 when ten existing neighborhoods were added <br />to the MUSA. Sewer service has now been provided to all of these ten neighborhoods. <br />The properly owners at 5 and 15 Brown Road had nonconfunning septic systems and connected to <br />the sewer line and were then added to the MUSA in the 2000 Comprehensive Plan amendment. At <br />that time, the septic system was not failing and the property owner at 25 South Brown Road was not <br />interested in connecting to sewer. This properly was inadvertently not added to the MUSA in the <br />2000 Comprehensive Plan update. There is a new property owner who is interested in connecting to <br />sewer as the existing septic system is i: j w failing. 3’his new owner bought the property based on the <br />availability of sewer. <br />Tliere are also four properties ,to the south, on the west side of Brown Road that were offered sewer <br />in 1999. These properties all have conforming septic systems and were not interested in connecting <br />to the sewer in 1999. The 2000 Compressive Plan approval by the Metropolitan Council invalidated <br />the pool of 50 sewer units that the City was granted in 1994 and under today ’s standards it would be <br />very difficult to obtain approval of a MUSA expansion for 2 acre density lots with confonning septic <br />systems. Tlierefore, these four properties are not being included in the MUSA expansion request. <br />Process <br />1 he public hearing is the Hist step in the process for completing a Comprehensive Plan amendment <br />to revise the MUSA. Once Planning Commission has completed the Public Hearing and <br />recommended approval, a Resolution will be presented to the City Council for conditional adoption <br />of the amendment subject to Met Council approval. The proposed amendment will be submitted to <br />the Met Council on their standard forms with supporting infomialion, and also submitted to adjacent <br />municipalities for comment. Once Mel Council has approved the amendment, theCitycan fomiallv <br />adopt it by resolution. After the amendment takes effect, actual construction of sewers and the <br />assessments for same arc topics primarily dealt with by the Council with no further Plannin <br />Commission action required. Preliminary discussions with Met Council staff indicate because th^ <br />area of the amendment is less than 40 acres, and because there are no impacts to metro systems th*^ <br />amendment will likely be considered as minor and timely approval would be cxnected ' ^ <br />^05-3083 MUSA Amciiiliiienl
