I»04-30I6 "Crccluidc in Oroiio**
Januar)’ 21,2005
Page 2
Legal Documents
SlafThas accepted tlie proposed language of llic various separate easement documents and the bylaws and
incorporation documents of the homeowners association. Staff is still working with the applicant" attorney
regarding the Developers Agreement and the Covenants. Noncofthc additional expected changes arc
believed to require specific Council action or discussion.
Road Name
Tire applicant had proposed the road name “CrecksidcTrail". The Police Dqiartmcnt has pointed out that
there is a Creekside Drive in Long Liikc, just north of Crecksidc In Orono, accessing off Watertown Road.
The PD believes this could cause confusion and has rejected “Crecksidc Trail” or any other name with
‘creekside’. Tlic applicant has suggcstctl Creek Ritlge Trail which could be confused in an emergency with
ourCreekwood frail in the N W corner of Orono. The PD would accept Creek Ridge if it’s not Trail or
Drive (Road, Lane, Court, Path, Circle, etc. arc other options). While Creek-something has been used
in many roads within the western suburbs, our goal is to create no more potential conflicting road names
within Orono ’s emergency services)urisdiction, as we have enough ah eady (Kelly Avenue vs Kelley
Parkway; Park Drive vs Park Lane vs Park Avenue; Crystal Bay Road vs Old Crystal Bay Road, etc.)
As of this writing we arc awaiting word from the developer as to further road name options.
Status of MCWD Permits
The applicant has advised that the MCWD pemiits will be issued shortly. As of this writing I have not
heard back from MCWD staff to confirm this, and have not received permits from the applicant.
Resolution
Tlic atfachetl resolution for Final Plat Approval incoqwratcs appropriate conditions ofqiproval, botli from
the Preliminary Plat Approval resolution and from the prior Council discussions. Please review the
Resolution to dctemiine whether any further revisions or additions arc necessar y.
Staff Recommendation
Staff recommends adoption of the attached Resolution for Final Plat Approval of CREEKSIDL IN
ORONO, subject to satisfactory completion of all required submittals, plans, documents, payments, etc.
prior to relea.scofthe plat and as.soeiatcd ilocuments for filing. Staff recommends that Council authorize
the Mayor, clerk and City stall" to execute the Developers Agreement once it has been approved by the
City Attorney and Planning Director.
COUNCIL ACTION REQUESI KD
1) Adopt or amend the attached lesolutiun.
2) Authorize the Mayor, clerk and City staff to execute the Developers Agi cement upon final language
apjiroval by the City Attorney and Planning Director.
I
•/
