PLUHM and SUSANNE PLUHM, <br />husband end wife, their heirs, successors and assigns (hereinafter <br />collectively referred to as the Grantors) and the CITY OF OEONO, <br />Its successors and assigns, a municipal corporation under the <br />laws of Che State of Minnesota (hereinafter referred to as the <br />Grantee). <br />WITNESSETHI Grantors, for and in consideration of the <br />sum of One Dollar ($1.00) and other valuable consideration, <br />hereby covenant, grant, quit claim and convey to Grantee the <br />right to rescricc and Grantors agree to limit and precluda the <br />use, improvement and development, under the conditions and <br />covenants herein contained, the following described Land in <br />the County of Hennepin and State of Minnesota: <br />Lot 1, Carman Bay Heights <br />as follows! <br />1. Grantors hereby covenant and agree <br />A. For the purpose of this easement hardcover is defined <br />as follows: <br />Any strxicture, blacktop or other material which <br />Interferas with the direct absorption of rainfall <br />into the ground. <br />B. The total square footage of hardcover allowed on <br />the property legally described above shall not exceed 33,000 <br />square feet such hardcover shall conform to all applicable <br />ordinances of the City of Orono. <br />C. Building structures and other imovovements governed <br />by these hardcover limitations which may be constructed upon <br />:hi .. . . . . . . . . . <br />the premises described herein shall be limited to: <br />1) Principal residence with amenities, including <br />but not limited to garage, swimming pool, driveway <br />and access roadways. <br />2) Tennis court. <br />3) Accessory building to tennis court not to exceed <br />80.) square feet of hardcover. <br />••.•SI <br />A) Guest house and/or servants quarters which shall <br />be constructed in the northerly 220 feet of the premises <br />herein described which together with any garage and/or <br />driveway shall not exceed 3,300 square feet of hardcover. <br />-.i <br />..-A * «««l
