\ <br />Zoning File #1654 <br />June 13, 1991 <br />Page 3 of 4 <br />The excess of some 4,000 s.f. of hardcover on the property must <br />be addressed by the City as a part of this current review. <br />As for the replacement of the former deck/access stair <br />structure within the lakeshore yard, applicant's application <br />notes the topography of the lakeshore bank necessitates a <br />structure to assist in access to the lake. The existing <br />structure was structurally unsafe and required immediate <br />replacement. It may be that the former owner never altered the <br />original stair structure at the time of the removal of the boat <br />house. In addition the improvements will result in a reduction <br />of approximately 116 s.f. of hardcover within the 0-75' setback <br />area. In discussions with the applicant, we reviewed the trials <br />and tribulations of many residents who have gazebos and similar <br />structures within their lakeshore yards and of staff's advise to <br />provide regular maintenance of these structures. Simple <br />maintenance functions each season rather than total replacement. <br />Total replacement of structures that do not meet the City's <br />informal standards (4' stair width and 4'x4' landings) do require <br />variance approval of the City. <br />Issues to be addressed in your considerations and recommendation: <br />1. now shall the Planning Commission address the excess amount <br />of hardcover controlled with the open space easement? There <br />is nothing in the files that suggest any later approvals <br />that would have allowed the loop configuration to remain for <br />the access drive. The lower level of the access stair <br />structure certainly appears to be the remnants of the sub­ <br />structure from the old boat house on the property, which was <br />supposed to be removed in the first variance review. You <br />may ask applicant to select the areas of existing <br />improvements to be removed so that the 33,000 s.f. is <br />retained on total property. <br />2.Will you allow two decks/landings for the access stair <br />structure? If upper substructure is removed, there may be <br />serious impact to the upper portions of the lakeshore bank. <br />Would you require additional removals of hardcover within <br />the 0-75' setback area to allow the 266 s.f. of new access <br />stair structure (note overall reduction of 116 s.f. of <br />hardcover within 0-75'). The thrust of the open space <br />easement was to consider this property as a whole. Review <br />Exhibit N, drainage has been defined. Note portions of 0- <br />75' setback area and the remaining 4 acres drain to <br />retention area within property - away from lake. In fact <br />this property receives major drainage from east, north and <br />west. How does this affect your consideration of the <br />access/stair structures?
