Zoning File #1654 <br />June 13, 1991 <br />Page 2 of 4 <br />Review of Application - <br />On April 26th a Stop Work Order was issued against the <br />property because an access stair structure was being constructed <br />on the property without the benefit of a permit review. The <br />owner has met with staff and has advised that the total project <br />will consist of the removal of one of the existing access stairs <br />(review Exhibits J and N). The stair to be removed totals 100 <br />s.f. of hardcover. Applicant proposes the reinstallation of an <br />access stairs similar to the previously installed one (review <br />Exhibits K & L). Hardcover with the reconstruction will be <br />reduced an additional 16 s.f. The former one was at 282 s.f.; <br />the proposed at 266 s.f. The overall reduction of hardcover in <br />the 0-75' zone will be at 116 s.f. Before we continue with the <br />review of the application, it is necessary to review the history <br />of this unique property and the land use applications previously <br />filed against this property. <br />In 1981, the City granted extensive hardcover variances <br />within the 75-250' setback area based on the applicant completing <br />removal of certain existing improvements (i.e. boat house within <br />lakeshore yard - review Exhibits D and E; and a loop driveway <br />section - review Condition 1, Resolution #1335 - Exhibit F and <br />site plan Exhibit D). Another condition of that variance approval <br />required the former owner to file a subdivision application as <br />owner had acquired lands to the east. The resulting 2 lot <br />subdivision was filed and finally approved in July of 1982. The <br />former property was increased from 1+ acres to 4.03 acres. A <br />condition of that subdivision approval required that the owner <br />execute an open space easement limiting all hardcover on the <br />total property to 33,000 s.f. (review Exhibit H). The open space <br />easement is filed against the chain of title. <br />Please review the total hardcover facts cited above. It <br />would appear that the site contains approximately 4,118 s.f. of <br />excessive hardcover and in violation of the City's Open Space <br />Easement filed against the property in 1982. In reviewing the <br />file for the variance application. Resolution #1335 - Exhibit F, <br />the boat house structure at 300 s.f. was to be removed and all <br />substructure removed out of the 0-75' setback area. In comparing <br />the location of the boat house structure on that former survey <br />(Exhibit D) with the current survey (Exhibit N) it would appear <br />that the substructure of the boat house may have been retained as <br />the lower deck area of the access stair structure. Review <br />Finding #5 of Resolution #1335. Condition #1 of that same <br />resolution would have required the redesign of the access drive <br />by removing approximately 3,000 to 3,500 s.f. of hardcover. <br />Applicant was not to have a looped design road but a single lane <br />drive approach to residence. Applicant's surveyor has also <br />advised staff that many of the items now included in the hard­ <br />cover inventory were not considered hardcover back in 1981-82 and <br />have now been included in the hardcover inventory. <br />,4 <br />f . <br />I HP lih I
