CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 7310 Page 1 of 2 A RESOLUTION VACATING A PORTION OF THE PERIMETER DRAINAGE AND UTILITY EASEMENTS WITHIN THE PLAT OF HARTZELL ADDITION, HENNEPIN COUNTY, MINNESOTA FILE NO. LA22-000041 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, on July 20, 2022, Michael Gorman on behalf of Watertower LLC, (hereinafter the “Applicant”), applied for vacation of a portion of the perimeter drainage and utility easements within Lot 1 and Lot 2, Block 1, Hartzell Addition legally described as follows and as depicted on Exhibit A: That part of the 10 foot wide drainage and utility easement centered on the common lot line of Lots 1 and 2, Block 1, Hartzell Addition which lies westerly of the westerly line of the easterly 10 feet of said Lots 1 & 2 and which lies southerly of the southerly line of the northerly 10 feet of said Lot 1. That part of the 10 foot wide drainage and utility easement centered on the common lot line of Lots 2 and 3, Block 1, Hartzell Addition which lies westerly of the westerly line of the easterly 10 feet of said Lots 2 and 3, Hennepin County, Minnesota. (hereinafter the “Easement”); WHEREAS, on October 17, 2022, after published and mailed notice in accordance with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, on October 17, 2022, the Planning Commission voted 6 in favor of and 0 against a motion to recommend approval of the requested vacation; and WHEREAS, on November 14, 2022, the City Council reviewed the application and the recommendations of the Planning Commission and City staff; and
