<br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />CITY OF ORONO <br />RESOLUTION OF THE CITY COUNCIL <br /> <br />NO. 7310 <br /> <br /> <br />Page 2 of 2 <br /> <br /> <br />WHEREAS, the Orono Council finds the vacation as proposed is in keeping with the public <br />interest and in consideration of the following findings: <br /> <br />1. The Easements were associated with a subdivision exception <br />whereby the common boundary between Lot 1 and Lot 2, Block 1, <br />Hartzell Addition was removed in order to combine portions of Lot 2 <br />with Lot 1 and with Lot 3 resulting in two lots where three lots <br />previously existed. And as a result the Easements were misplaced, <br />and are no longer necessary. <br /> <br />2. There are no drainage or utility improvements within the Easement. <br /> <br />3. A new 10-foot perimeter drainage and utility easement was <br />dedicated on the new common boundary line between the northern <br />lot and the southern lot in the place of the Easements to be vacated. <br /> <br />4. The City Council finds that the existing, orphaned Easements to be <br />vacated have no apparent present or future benefit to the public. <br /> <br />5. The City Council finds that: <br />a. The vacations do not affect access to or use of any adjoining <br />property. <br />b. The City does not intend to develop, improve, or use the <br />existing Easement. <br />c. A new drainage and utility easement in favor of the City will <br />be dedicated on the new common boundary as depicted on <br />Exhibit A. <br />NOW, THEREFORE, BE IT RESOLVED, that the vacation of the <br />drainage and utility easement area as described above is hereby granted by the <br />City Council of the City of Orono on this 14th day of November, 2022. <br /> <br />ATTEST: <br /> <br /> <br /> <br />________________________ __________________________ <br />Anna Carlson, City Clerk Dennis Walsh, Mayor <br /> <br />
