To adopt a resolution approving the vacation of existing drainage and utility easements. <br />Replacement easements will be granted. <br /> <br />2. MN§15.99 Application Deadline. The application was received and considered to be complete on <br />July 20, 2022. The 60-day review period has been extended and now will expire on November 17, 2022. <br /> <br />3. Background/ Summary. The applicant has plans to combine the existing three Hartzell Addition <br />properties into two. Half of existing the existing middle lot, 2987 Casco Point Road, will be combined <br />with the “tennis court lot” (PID 20-117-23-34-0027). The remaining half of 2987 Casco Point Road will <br />be combined with 3005 Casco Point Road, resulting in the “Subject Property” for this application. This <br />application focuses on the to-be-created 3005 Casco Point Road depicted in Exhibit B, attached. <br /> <br />The aforementioned lot combinations will be completed by an administrative combination of three <br />buildable lots resulting in two buildable lots. The applicant has requested approval to vacate drainage and <br />utility easements relating to this administrative combination. New replacement easements will be <br />established on the new boundary line. <br /> <br />4. Public Comment. No written comments from neighbors were received. Public comment was <br />provided at the Public Hearing and is detailed in the Draft Planning Comment Minutes attached as <br />Exhibit C. The primary concern voiced at the meeting was drainage of the new development. <br />Additionally, comments from the DNR and utility companies are attached as Exhibit D. <br /> <br />5. Planning Commission Vote and Comment. On October 17th, the Planning Commission held a <br />public hearing. Following the public hearing and discussion, the Planning Commission voted 6 to 0 on a <br />motion to approve the easement vacation conditioned upon establishment of replacement drainage and <br />utility easements over the new property dividing line. <br /> <br />6. Staff Recommendation. Staff recommends approval. <br /> <br />COUNCIL ACTION REQUESTED <br />1. Motion to adopt Resolution No. 7310. <br />2.
