<br />1 <br />EMPLOYMENT AGREEMENT <br /> <br />THIS AGREEMENT is made and entered into this _____ day of ______, 202_ between the City <br />of Orono, Minnesota (the “City”), and James Van Eyll (the “Fire Chief”). <br /> <br />BACKGROUND FACTS <br /> <br />A. The City wishes to employ the services of James Van Eyll as the Orono Fire <br />Department Chief of Fire, who reports to the Orono City Administrator. <br />B. The City and James Van Eyll desire to provide for certain procedures, benefits and <br />requirements regarding the employment of James Van Eyll by the City. <br />C. James Van Eyll wishes to accept employment as the Fire Chief, under the terms and <br />conditions of this Agreement. <br /> <br />TERMS OF AGREEMENT <br /> <br />In consideration of the facts mentioned above and the mutual promises set out below, the parties <br />agree as follows: <br /> <br />1. Duties: City agrees to employ James Van Eyll as the Fire Chief of the City of Orono Fire <br />Department to perform all duties as specified by law and ordinance and perform such other <br />proper duties as assigned by the City Council and the Administrator. <br /> <br />2. Compensation: Employer shall pay Employee a salary of $116,513 (Grade 15/Step 6) <br />per year starting December 30th, 2022. Employee shall be given an initial performance <br />review after six (6) months and annually, on Employee’s anniversary date, thereafter by the <br />City Administrator. Employee shall be eligible for a step increase on Employee's <br />anniversary date subject to satisfactory performance evaluation. Employee shall also be <br />eligible for a COLA increase at the beginning of the year consistent with other non-union <br />employees. <br />3. Seniority: For the purposes of employment benefits, the Fire Chief will be credited <br />with a start date of March 2008. Benefits include but are not limited to vacation, sick leave, <br />longevity pay and severance benefits. <br />4. Terms and Conditions: The Fire Chief will serve at the will of the City Council and may <br />be terminated with or without cause at any time. Any of the following will constitute <br />termination with cause and would result in no severance: <br /> <br />a. Inefficiency or incompetence in office that is not corrected after a reasonable <br />identification of deficiency during the annual performance evaluation or other performance <br />evaluation and after being given an appropriate opportunity to correct to the satisfaction of the <br />majority of the City Council. <br /> <br />b. Legal Malfeasance or nonfeasance in office. <br />
