Aslipt#ould be available for each <br />of the rental units. Mabusth advised that in the <br />absense of a survey, it was impossible to <br />determine if there was sufficient dock use area <br />to permit the seven slip use. Staff reviewed the <br />plat map of the immediate neighborhood noting <br />that if the side property lines of the neighbor to <br />the northwest were extended that it severly <br />limits the "Resorts* dock use area. Mabusth <br />noted that this is a new application and that the <br />L.M.C.D. would have to apply the formula of 1 boat <br />per 50* of shoreline. The subject property has <br />185* of shoreline limiting the density level* to 4 <br />slips. <br />Grabek'^uestioned the real need for a survey <br />since Maciosek had reconciled the encroachment <br />problem on the south side of the property two <br />seasons ago and that unless the neighboring <br />property owners were still complaining, the City <br />should be able to make a recommendation without a <br />survey. Prahm questioned to what degree the <br />City would be held legally responsible if there <br />was an accident and the City approved the license <br />without some type of approval from the neighbors. <br />The docks are far removed from the heavily <br />trafficked area of the lake and the area is <br />limited to local boat users. Prahm moved to <br />table action on the licnese application subject <br />to the applicant obtaining letters from the two <br />adjacent property owners noting approval of <br />proposed 2 dock, 7 slip layout. If the applicant <br />is unable to obtain the necessary letters then a <br />survey of the shoreline and dock use area will be <br />required prior to any action of the Marina <br />Committee. The Chairman noted <br />that once again the application involves no <br />changes from last years level of use nor in the <br />dock layout. Prahm moved to recommend approval <br />of a 1983 commercial dock license for the <br />Minnetonka Boat Works.
