MINUTES OP THE PLANNING COMMISSION MEETING HELD SEPTEMBER 16, 1985. PAGE 6 <br />«952 KOKESH continued <br />Mr. Oberhauser explained how the issue of the necessity of a <br />conditional use permit came about. He stated that since the <br />ordinance came into effect in 1975 this property has been <br />permitted use as a stock farm. Mr. Oberhauser referred to <br />two issues that have been brought up, the selling of tack and <br />periodic riding lessons. He explained that Mrs. Kokesh <br />takes orders over the phone for special types of tack and it <br />should be considered manufacturer's representative type of <br />business rather than a production commercial type of <br />business. He also explained that the Kokesh daughter <br />periodically gives lessons to accommodate the boarders. <br />Mr. Oberhauser requested direction on the types of permits <br />required. <br />Zoning Administrator Mabusth stated that within the <br />recreation section of the code a conditional use permit is <br />required because of the riding acadamy nature; and a variance <br />would be required for the home occupation. Mabusth <br />recommends that Mr. Oberhauser's client file formal <br />applications for a conditional use permit and a variance. <br />Earl Dorn, 4045 Watertown Road, was present to state his <br />feelings regarding this matter. He stated that it has taken <br />the City a year to act on this and it is clearly a public <br />stable. He feels that the ordinance should be applied <br />equally to residents. He stated that the problems include the <br />increased traffic because of the horse shows, chuckwagons, <br />loudspeakers, tack and lessons are adverti sed. He also noted <br />that the City building inspector should check to see if all <br />the buildings on the property were built under the authority <br />of building permits. Mr. Dorn stated that if the applicant <br />were to apply for the necessary permits, he would be opposed <br />to the unlimited expansion of the operation. <br />Kelley stated that there seemed to be no problems at the horse <br />shows he has attended at this property regarding the traffic <br />and operation. He further stated that he never saw any type <br />of over-the-counter sales of tack. <br />Simv stated that he feels this is a proper use in this area and <br />encourages it. <br />Ocetten stated that conditions and limitations should be set <br />on these types of operations. <br />Mr. Oberhauser stated that he felt the type of sales of tack <br />involved were covered under the home occupation section <br />because the sales were limi«^od and of the catalogue type. <br />Planning Commission concurred that applicant should file the <br />appropriate applications upon staff's recommendation to be <br />heard before the Planning Commission.
