H- <br />CITY of ORONO <br />L<CITY <br />OF <br />ORONO <br />1 <br />>m <br />Post Office Bo* G6*CrytUl Bay, Minnesota 55323 • Municipal Offices <br />On the North Shore of Lake Minnetonka <br />May 20, 1985 <br />George Rovegno, Jr. <br />2010 Shoreline Drive <br />Wayzata, MN 55391 <br />Dear George: <br />Unfortunately, I must send this letter to advise that the <br />fence erected in your lakeshore yard on or about May 11, 1985 is <br />in violation of the Municipal Zoning Code. The fence would <br />appear to measure between 5 to 6 feet in height above existing <br />grade, placed approximately 20 to 25 feet from the shoreline and <br />at the edge of the newly defined right-of-way of County Road 15 <br />that intersects your lakeshore lot. I cite for your con <br />sideration Section 10.22, Subdivision 1 as amended by Council on <br />January 5, 1985: <br />Subdivision 1. Lakeshore Set Back Regulations. The set <br />back from the shoreline for lakeshore lots shall be at least <br />75 feet and no building, fence or wall over forty-two inches <br />but not in excess of seventy-two inches in height above <br />original grade may be located closer to the shoreline than <br />residence buildings on adiacent lots. <br />Although, I have not discussed this matter with you, it <br />would be my guess that you erected the fence per newly amended <br />Section 10.03, Subdivision 15 (C) that you helped author as <br />follows: <br />C. Fences which do not exceed 3 1/2 feet in height, fences <br />not oyer six feet in height a long the street lot 1ine of <br />lake frontage lots which f ront on a major thoroughf a re, if <br />lAii required, the tota 1 combined height of both fence <br />and f_i 1.1^ sha 11 not exceed ^ feet above the height of the <br />crown of the road, terraces, steps, uncovered porches. <br />stoops or similar structures, which do not extend above the <br />heiglit of the ground floor level of the principal building <br />and extend to a distance of not less than two feet from any <br />lot line. <br />Your lot, your neighbors' lots-all lots adjacent to the <br />shores of Lake Minnetonka, where County roads, private roads, <br />easement roads intersect lakeshore yards, are subject to the <br />standards of our code that protect and assure the viewing rights <br />of lakeshore lot owners. <br />Bt’IlUISG * ZOMNC; - 47J 7357 • ADMIMSTRATION 4 riSANCl - 473 7358 • PUBLIC WORKS 473 7359 <br />ASSlSSINt; <br />1 <br />\
